Terms of Service

1. Account Eligibility
SARGOS is designed for search and rescue organizations, emergency management agencies, and related professional and volunteer teams. By creating an account, you represent that you are authorized to act on behalf of your organization and that you are at least 18 years of age.
2. Acceptable Use
You agree to use SARGOS only for lawful purposes related to search and rescue operations, emergency management, and related training activities. For a complete list of prohibited uses, see our Acceptable Use Policy.
3. Free Trial and Demo Plan
New organizations start on the free Demo plan with limited features and a member cap. The Demo plan is provided at no cost and does not require a credit card. You may upgrade to a paid plan at any time.
If a promotional trial of paid features is offered, the trial duration and terms will be disclosed at the time of enrollment. At the end of a trial period, your account will revert to the Demo plan unless you subscribe to a paid plan. No charges are incurred during a trial period.
4. Subscription and Auto-Renewal
Paid subscriptions (Team and Enterprise plans) are billed on a recurring basis — monthly or annually, as selected at checkout. Subscriptions automatically renew at the end of each billing period at the then-current rate unless canceled before the renewal date.
You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period — you retain access to paid features until that date.
Per-seat pricing is based on the number of active members in your organization at the time of each billing cycle.
5. Refund Policy

SARGOS subscriptions are non-refundable except as required by applicable law. If you cancel your subscription, you will not receive a refund for the current billing period, but you will retain access to paid features through the end of that period.
If you believe you were charged in error or experience a service outage that materially prevents use of the platform, contact us within 30 days of the charge. Refund requests are evaluated on a case-by-case basis.
6. Data Ownership
Your organization retains ownership of all data entered into SARGOS, including incident records, personnel data, map data, ICS forms, and any other content created within the platform. SARGOS does not claim ownership of your data.
7. Intellectual Property

The SARGOS platform, including its software, design, logos, documentation, and all related intellectual property, is owned by the operator and protected by copyright, trademark, and other applicable laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for your organization's internal operations during the subscription term.
You may not reverse-engineer, decompile, or create derivative works based on the platform. You may not sublicense, resell, or redistribute access to the platform.
8. Service Availability
SARGOS is provided on an “as available” basis. While we strive for high availability, we do not guarantee uninterrupted access to the service. Scheduled maintenance windows will be communicated in advance when possible.
9. Warranty Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SARGOS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability

To the maximum extent permitted by applicable law, SARGOS and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including but not limited to loss of data, loss of revenue, or damages arising from operational decisions made using information displayed in the platform.
In no event shall the total liability of SARGOS exceed the amount paid by your organization in the twelve (12) months preceding the event giving rise to the claim.
11. Indemnification

You agree to indemnify, defend, and hold harmless SARGOS and its operators, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) operational decisions made by your organization using the platform.
12. Life-Safety Disclaimer
Important
SARGOS is an information management and coordination tool. It is not a safety system. All field decisions, risk assessments, safety evaluations, and operational judgments remain the sole responsibility of the Incident Commander and authorized personnel.
SARGOS does not provide medical advice, navigation guidance, weather forecasting, or any form of automated decision-making for field operations. The platform displays information as entered by users and does not independently verify the accuracy, timeliness, or completeness of that information.
No feature of SARGOS — including but not limited to personnel tracking, resource management, mapping, or ICS form generation — should be relied upon as the sole source of truth for life-safety decisions.
13. Termination

We may suspend or terminate your access to the service at any time if you violate these Terms or the Acceptable Use Policy, or if required by law. We will provide reasonable notice where possible.
Upon termination, your right to use the service ceases immediately. Your data will be preserved for the period described in Section 14 (Data Portability on Cancellation) before permanent deletion.
14. Data Portability on Cancellation
If your organization cancels its subscription or the subscription lapses past the grace period, your organization will retain read-only access to incident history. Organization Administrators can export incident data (CSV), ICS form PDFs, and map data (GeoJSON/KML) during this period. Data is preserved for 90 days after cancellation before deletion.
15. Dispute Resolution

Any disputes arising from or relating to these Terms or your use of the service shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
Class action waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action.

17. Changes to These Terms
We may update these Terms of Service from time to time. When we make material changes, we will notify you through the SARGOS application and update the “Last updated” date at the top of this page. Your continued use of the service after such changes constitutes acceptance of the updated terms.
